The Sussex County Sheriff's Office handles OPRA requests for arrest records at the county level. The records custodian is Undersheriff Matthew Avenatti. The office is at 39 High St, Newton, NJ 07860. If fees go past $25, a deposit is due up front.

One rule to note is that the Prosecutor will not accept anonymous requests for victim records. If the record involves a victim, you must provide your name and reason for the request. Standard arrest records, case files, and court documents do not fall under this rule. Those are open to the public under N.J.S.A. 47:1A-1, which is the Open Public Records Act.

The Prosecutor handles all grand jury cases in Sussex County. After an arrest, the case goes to a grand jury if the charge is serious enough. If the grand jury votes to indict, the case moves to Superior Court. The Prosecutor's file for each arrest includes the police report, witness statements, lab results, and other evidence. Most of this is part of the public record once the case is closed, unless the court has sealed it under N.J.S.A. 2C:52-1.
